{"id":1069,"date":"2024-04-25T12:36:09","date_gmt":"2024-04-25T10:36:09","guid":{"rendered":"https:\/\/pcr-wp.ddev.site\/how-to-check-the-legal-stay-of-a-ukrainian-citizen-in-poland\/"},"modified":"2026-06-10T11:45:13","modified_gmt":"2026-06-10T09:45:13","slug":"how-to-check-the-legal-stay-of-a-ukrainian-citizen-in-poland","status":"publish","type":"post","link":"https:\/\/dev.pcr-legal.pl\/en\/how-to-check-the-legal-stay-of-a-ukrainian-citizen-in-poland\/","title":{"rendered":"How to Check the Legal Stay of a Ukrainian Citizen in Poland?"},"content":{"rendered":"<p class=\"wp-block-paragraph\">Last updated: 24 April 2024.<\/p>\n<p class=\"wp-block-paragraph\">The legality of the Ukrainian citizen&#8217;s stay in Poland is a key requirement for compliance with Polish labour law. Employers are obliged to carefully verify two aspects before hiring a foreigner: the first is the legality of their stay, and the second is the right to work in Poland.<\/p>\n<p class=\"wp-block-paragraph\">For Ukrainian citizens, there are special provisions resulting from the war-specific<sup data-fn=\"df2ae26c-30bb-44ec-b0af-032532fc88aa\" class=\"fn\"><a id=\"df2ae26c-30bb-44ec-b0af-032532fc88aa-link\" href=\"#df2ae26c-30bb-44ec-b0af-032532fc88aa\">1<\/a><\/sup> introduced in response to the war situation. This special law introduces simplification and special rules for displaced persons (inappropriately often called refugees \u2013 which is a different category in Polish law) and their families, facilitating the legalisation of residence and access to the labour market.<\/p>\n<h2 class=\"wp-block-heading\">Expatriations from Ukraine<\/h2>\n<p class=\"wp-block-paragraph\">For displaced persons from Ukraine <strong>and their spouses<\/strong>compliance with the requirements is required:<\/p>\n<p class=\"wp-block-paragraph\">1. <strong>Legal<\/strong> coming to Poland \u2013 whether directly from ter. Ukraine or not;<br \/>2. Arrival on the day <strong>24 February 2022 or later<\/strong>;<br \/>3. Arrival caused by <strong>war action<\/strong> against Ukraine;<br \/>4. declaration <strong>intention to stay in Poland<\/strong>.<\/p>\n<p class=\"wp-block-paragraph\">In practice, sufficient proof of compliance is considered to have a PESEL number with a special UKR status and an important document from the mCitizen application, known as Dia.pl, which serves as a digital version of the residence card. <a href=\"https:\/\/info.mobywatel.gov.pl\/dokumenty\/diia\" target=\"_blank\" rel=\"noopener\"><em>(Information about Diia.pl)<\/em><\/a><\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">The holding of PESEL UKR is not a requirement clearly defined in the law, but the practice of inspection authorities and employers shows something else.<\/p>\n<\/blockquote>\n<p class=\"wp-block-paragraph\">Such a legalized stay at present is valid until 30 June 2024 (in some special cases \u2013 until 31 August or 30 September 2024).<\/p>\n<h2 class=\"wp-block-heading\">Extension of residence permits<\/h2>\n<p class=\"wp-block-paragraph\">Speciality significantly prolongs<sup data-fn=\"8faf52a6-b77f-447f-97a5-4e5ec75ededd\" class=\"fn\"><a id=\"8faf52a6-b77f-447f-97a5-4e5ec75ededd-link\" href=\"#8faf52a6-b77f-447f-97a5-4e5ec75ededd\">2<\/a><\/sup> period of validity of the following documents, if their term of validity expires 2<strong>February 4, 2022 or later:<\/strong><\/p>\n<p class=\"wp-block-paragraph\">\u2013 national visas;<br \/>\u2013 temporary residence permits;<br \/>\u2013 documents \u2018acceptable residence permit\u2019.<\/p>\n<p class=\"wp-block-paragraph\">In addition, the Act allows for the extension of the legal residence of foreigners on the basis of:<\/p>\n<p class=\"wp-block-paragraph\">\u2013 on the basis of a Schengen visa;<br \/>\u2013 on the basis of a temporary stay issued by another Schengen State;<br \/>\u2013 in the framework of visa-free movement;<\/p>\n<p class=\"wp-block-paragraph\">provided that the last day of their legal stay in Poland falls <strong>24 February 2022 or later<\/strong> and is extended to <strong>30 June 2024.<\/strong><\/p>\n<p class=\"wp-block-paragraph\">Important: This extension does not automatically entitle you to cross borders or reside in other Schengen countries. Each case should be considered individually.<\/p>\n<p class=\"wp-block-paragraph\">Accordingly, a Ukrainian citizen has the right to use the above-mentioned documents if their validity is from 22.02.24.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Currently, the law extends the validity of documents until 30 June 2024, but it is possible to extend this deadline further in accordance with decisions of the Council of the European Union. Any changes will be kept up to date. <\/p>\n<\/blockquote>\n<h2 class=\"wp-block-heading\">Standard documents<\/h2>\n<p class=\"wp-block-paragraph\">Of course, Ukrainian citizens can use standard documents, like any other foreigner, i.e.:<\/p>\n<p class=\"wp-block-paragraph\">\u2013 temporary stay;<br \/>\u2013 permanent stay;<br \/>\u2013 residence of EU long-term resident;<br \/>\u2013 visa;<\/p>\n<p class=\"wp-block-paragraph\">whose validity and rules of issue are governed by Polish law and international agreements. Find out how we can help you!<\/strong><\/a><\/p>\n<h2 class=\"wp-block-heading\">Notification of entrustment of work to a Ukrainian citizen<\/h2>\n<p class=\"wp-block-paragraph\">According to the special law, all legally resident citizens of Ukraine, are employed through a simplified procedure, known as <strong><a href=\"https:\/\/warszawa.praca.gov.pl\/powiadomienie-o-podjeciu-pracy-przez-obywatela-ukrainy\" target=\"_blank\" rel=\"noopener\">Notice of entrustment of work to a Ukrainian citizen<\/a>.<\/strong>&nbsp;<\/p>\n<p class=\"wp-block-paragraph\">Start <strong>immediately<\/strong> After confirming the legality and his whereabouts. The job-telling entity is obliged <strong>within 14 days<\/strong> to send a notification to the competent Labour Office by means of a Party <em><a href=\"https:\/\/www.praca.gov.pl\/eurzad\/uslugi-elektroniczne\/kreator-wnioskow\/PSZ-PPWPU\" target=\"_blank\" rel=\"noopener\">www.praca.gov.pl.<\/a><\/em> This procedure is <strong>Free.<\/strong><\/p>\n<p class=\"wp-block-paragraph\">We are waiting for legislative decisions to determine what the employment procedure will look like after 30 June this year.<\/p>\n<p class=\"wp-block-paragraph\">Note: For Ukrainian citizens holding PESEL with active status of UKR, the notification of entrustment of work is currently the only way to legalise their employment in Poland.<\/p>\n<h2 class=\"wp-block-heading\">Statement of entrustment of work to a foreigner<\/h2>\n<p class=\"wp-block-paragraph\">For Ukrainian citizens who are not protected for displaced persons, the possibility of employment is available through <em><a href=\"https:\/\/www.biznes.gov.pl\/pl\/opisy-procedur\/-\/proc\/1610\" target=\"_blank\" rel=\"noopener\">statements about entrusting work to a foreigner.<\/a><\/em><\/p>\n<p class=\"wp-block-paragraph\">The declaration shall allow work for a maximum period of 24 months.<\/p>\n<p class=\"wp-block-paragraph\">The cost of the procedure is <strong>100 z\u0142.<\/strong><\/p>\n<p class=\"wp-block-paragraph\">In practice, the most common time to wait for entry in the register lasts 1-2 months.<\/p>\n<p class=\"wp-block-paragraph\">Starting work can only begin <strong>after obtaining information on the entry of a statement in the register.<\/strong> During the waiting period, the posting of work to a foreigner is not allowed.<\/p>\n<p class=\"wp-block-paragraph\">After the start and completion of work by the foreigner \u2013 entity <strong>obliged<\/strong> is to inform the Labour Office of this fact.<\/p>\n<h2 class=\"wp-block-heading\">Work permit or uniform application<\/h2>\n<p class=\"wp-block-paragraph\">There is also the possibility of hiring a Ukrainian citizen who <strong>is not protected<\/strong> (i.e. it does not have a PESEL UKR in simplification) through a standard procedure including: <\/p>\n<p class=\"wp-block-paragraph\">1. <strong><em><a href=\"https:\/\/www.biznes.gov.pl\/pl\/opisy-procedur\/-\/proc\/1611\" target=\"_blank\" rel=\"noopener\">Work permit<\/a><\/em><\/strong> \u2013 where the applicant is the employer, or<br \/>2. <strong>Single residence and work permit<\/strong> \u2013 when the applicant is a foreigner himself<\/p>\n<p class=\"wp-block-paragraph\">Practice shows that it is feasible <strong>Single Authorisation<\/strong> to stay and work is a very time-consuming procedure. Depending on the Voivodeship (the permit is issued by the Province responsible for the foreigner&#8217;s residence address), the procedure may last from 3 months to in extreme cases 2-3 years!<\/p>\n<p class=\"wp-block-paragraph\">Authorisation is issued on a specific entity and the possibility of employment of a foreigner may take place <strong>only under the conditions laid down in the permit.<\/strong><\/p>\n<p class=\"wp-block-paragraph\">Important: Foreigner <strong>can&#8217;t<\/strong> start work before receiving a permit.<\/p>\n<h2 class=\"wp-block-heading\">Other cases of dismissal<\/h2>\n<p class=\"wp-block-paragraph\">There are exceptions where the transition through the standard procedure for legalising employment is not required. In any case, they concern <strong>citizens with no UKR status.<\/strong><\/p>\n<p class=\"wp-block-paragraph\">With the obligation to have a work permit \/ declaration of entrustment of work, foreigners are allowed to meet one of the following conditions:<\/p>\n<p class=\"wp-block-paragraph\">\u2013 have refugee status granted in Poland;<br \/>\u2013 benefit from subsidiary protection in Poland;<br \/>\u2013 have a permanent residence permit in Poland;<br \/>\u2013 hold a residence permit of a long-term resident of the European Union in Poland;<br \/>\u2013 have permission to stay for humanitarian reasons;<br \/>\u2013 have permission to stay tolerated in Poland;<br \/>\u2013 use temporary protection in Poland;<br \/>\u2013 have a valid certificate of protection in the territory of Poland;<br \/>\u2013 they are resident in the territory of the Republic of Poland on the basis of a residence permit issued by another Member State of the European Union and the purpose of their stay in the territory of the Republic of Poland is to carry out work as a manager, specialist or employee in the course of an intra-corporate transfer for a period not exceeding 90 days in 180 days;<\/p>\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/dev.pcr-legal.pl\/en\/contact\/\"><strong>Aren&#8217;t you sure what documents are needed?
