What is a permanent residence permit?

Permanent residence permit in Poland is an administrative decision which gives the foreigner the right to stay in Poland for an indefinite period. After a positive decision, a permanent residence card is issued as a document confirming the residence status.

It is a form of legalization of stay, which allows to live in Poland permanently without the need to renew permits. It may be awarded, among others, on the basis of Polish origin, the Polish Charter, marriage to a Polish citizen or other statutory conditions.

Frequently asked questions about a temporary residence card
What documents are needed for permanent residence?

The scope of the documents depends on the basis of the proposal. A valid passport, application form, photos, document confirming the basis of permanent residence (e.g. Polish card, marriage certificate, documents confirming origin, international protection decision), confirmation of the check-in or address of the stay and proof of the tax fee are usually required. In some cases, the office may request additional documents.

How long does the application for permanent residence take?

Under the rules, the case should be dealt with without undue delay and in cases more complicated than two months after the initiation of the procedure. In practice, waiting times are longer and depend on the provincial office, the number of cases and the completeness of documents.

Can I apply before the end of the visa or current stay?

Yeah. The application must be submitted during a legal stay in Poland, preferably before the expiry of the visa, visa-free movement or current residence card. The timely submission of the application in principle allows to remain legally in Poland until the decision is made.

Who can be granted a permanent residence permit in Poland?

The law provides for several grounds, including: Polish origin, possession of the Polish Charter, marriage to a Polish citizen after fulfilling statutory conditions, refugee status or subsidiary protection, residence tolerated in certain cases and some other situations indicated in the Foreigners Act.

Can I work in Poland after applying?

Just submitting an application does not always give automatic right to work. This depends on your previous residence status and employment base. Upon permanent residence, the foreigner has free access to the labour market in Poland without a work permit.

What if the office calls me to complete my papers?

Reply within the time limit indicated in the letter and provide the required documents or explanations. Failure to react may leave the application unidentified or a negative decision is taken. It is worth carefully examining the content of the call.

Do you help after a refusal?

Yeah. An appeal may be brought against a refusal to the second instance within the time limit specified in the instruction of the decision (typically 14 days after service). In some cases, a complaint to the administrative court is also possible.

Are you helping cases after a long inactivity of office?

Yeah. If the office does not take action for a long time, a reminder may be lodged and, in certain situations, an action may be brought before the administrative court.

Are you helping customers outside the Pomeranian Voivodeship?

Yeah. Many stages of the case can be conducted remotely. However, it should be remembered that the competent provincial office depends on the whereabouts of the foreigner in Poland.
